Terms
These terms are a contract between you and Gonevertical LLC, a Hawaii limited liability company doing business as Krest (“we,” “us”). They govern www.getkrest.com (the “Site”).
By using the Site you agree to them. If you do not agree, do not use the Site. English controls. The Privacy notice is part of these terms.
What the Site is
The Site is marketing: product explanation, a blog, a waitlist, and a contact form. There is no public signup, no paid plan, and no customer app on this host. Screens and checklists you see here are illustrative. They can change before anyone is invited.
You must be 18 or older and acting for a business or other organization.
Waitlist
Submitting /waitlist asks us to consider you for access. It is not a contract for access, a price, a feature set, or a launch date. We may invite, reorder, or refuse anyone. We may email the address you gave about access and “your turn.” That is not a newsletter. Details are in the Privacy notice.
You own what you type in a form. You grant us a limited license to use it to reply, run the waitlist, and operate the Site. We do not claim your patents because you left a suggestion.
Acceptable use
Do not:
- Use the Site for anything illegal
- Attack, overload, or interfere with hosting
- Submit malware or harvest other people’s data through our forms
- Impersonate us or anyone else
- Scrape the Site in a way that degrades it for others
Automated access that our robots.txt already allows (including listed AI crawlers) is not a breach of this section. We may still rate-limit abuse.
Our intellectual property
The Krest name, lockup, Site copy, and product mocks are owned by Gonevertical LLC. You may quote a short passage with attribution. You may not copy the Site, the mark, or the mocks as your own product. Fair use remains fair use.
IP complaints: sales@getkrest.com. We do not publish a designated DMCA agent on this page.
Feedback
If you send an idea, we may use it without paying you and without taking ownership of intellectual property you already had. This is a non-exclusive license, not an assignment.
Third-party sites
Links to X, LinkedIn, FormSubmit, Google Fonts, and other hosts are their services. Their terms apply when you leave the Site.
No professional advice
Nothing on the Site is legal, privacy, security, or investment advice. “AI drafts. You ship.” is a product rule, not a warranty that a draft is lawful for you.
Disclaimer
The Site is provided “as is.” We disclaim all warranties to the fullest extent Hawaii law allows, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that mocks will match a future product or that the Site will be uninterrupted.
Limitation of liability
You pay nothing to browse. To the fullest extent the law allows, we are not liable for lost profits, lost data, or consequential damages arising from the Site. Our total liability for the Site is $100. Some places do not allow these limits; there they apply only as far as the law allows.
You will cover us for claims that come from your unlawful use of the Site or from content you submitted that you had no right to send. This is not a general enterprise indemnity.
Changes, assignment, notices
We may change these terms by posting a new date on this page. If you keep using the Site after that date, you accept the new terms. You may not assign these terms. We may assign them with the LLC. Email to the address you gave us, or a notice posted on the Site, counts as written notice. Notices to us go to sales@getkrest.com.
Export
Do not use the Site if you are in a jurisdiction comprehensively sanctioned by the United States, or if you are on a US denied-party list. We may block access if we believe that is happening.
Force majeure
We are not liable for delay or failure caused by events we do not control: outage at a host or DNS, government act, disaster, or a similar event. This does not excuse a payment obligation, and this Site does not charge you.
Governing law
Hawaii law governs, without regard to conflict-of-law rules. Courts located in the State of Hawaii have exclusive venue. There is no arbitration clause and no class-action waiver. If a court finds a section unenforceable, the rest stays. A failure to enforce a section once is not a waiver.
These terms plus the Privacy notice are the entire agreement about the Site.
When you are invited
Access is allowlisted. We may suspend or end it at any time. There is no uptime commitment. There is no public price on this Site; when fees exist we will say so before we charge.
You own your workspace content. We own the software, models-as-configured in our stack, and the Krest brand. You grant us a license to host and process your content only to provide the product to you. You are the controller of your end users’ data. Gonevertical processes it to provide the product. A data processing agreement is available on request and applies when we have executed one with you. These terms are not a signed DPA.
If you load the embed on your product, you must have a lawful basis and a notice for those people. You are responsible for your end users and for any message, tour, checklist, form, webhook, or email you publish or send. Model output (operator drafts and in-app guide answers) is a draft. As between us, you own the drafts generated for your workspace. Drafts can be wrong, incomplete, or similar to drafts another operator receives. You verify before you publish. We do not warrant that a draft is accurate, non-infringing, or lawful in your industry. Guide chat cannot send email or publish for you.
Do not use the product to send unlawful email, to break another service’s terms in a way that lands on us, or to probe our systems. Do not reverse-engineer the product or use access to build a competing service. Do not upload HIPAA, PCI, or other special-category data unless we have a written agreement for that class. No SMS. We do not collect cards on this Site.
A published embed key is a customer-controlled public token. Anyone who has it can identify and track on that key. The publish key and the webhook HMAC secret are secrets. We show each once at create or rotate. You store them. You do not put them in customer HTML or in embed.js.
Live inbound webhooks are rejected unless they carry a valid HMAC, timestamp, and nonce. The only mutating inbound action today is identify_user. HubSpot and Salesforce controls in the product are simulations. They do not call those vendors. Outbound POSTs we send to URLs you configure are your destinations. You are responsible for what those hosts do with the payload.
If you send live marketing email through Krest, you are responsible for consent and for your own lists. Public identify cannot grant marketing consent. When the unsubscribe secret is configured, Krest adds List-Unsubscribe and List-Unsubscribe-Post with an HMAC token (not the raw address). That does not shift list or consent duty to us.
Private access is confidential. You may talk about the fact that you were invited. You may not publish our unpublished admin UI, keys, or other customers’ data.
You may stop using the product at any time. We may terminate access if you breach these terms or if we shut the private program down. From User detail, an operator can export a person (workspace User plus live person and events for staging and production) and erase both environments. There is no public self-serve portal. Export the workspace before access ends. After we end access we may delete it. If you cannot reach the product, write sales@getkrest.com.
If Part A and Part B conflict, Part A governs the public Site and Part B governs product use after invite.
